This unit seeks to develop an understanding of banking law and practice by applying rules of familiar fields of law, such as contract, tort and trusts, to the special issues raised by banking, and to examine the traditional aspects of banking law such as cheques, lending and combination of accounts, as well as exciting new developments in practice (like internet and other technologically innovative methods of payment) and in legal regulation, which is changing dynamically to keep up with the dramatic social, economic and technological changes. The unit considers the banker-customer relationship in the modern world and the implications of money laundering and of increasing customer expectations for banks. The emphasis is on an evaluative and broader contextual approach to the law and practice, and students will be encouraged to analyse and assess the law in the light of moral and social values.
