The modern commercial property lease in England is a complex document, seeking to achieve a range of objectives, many outside of traditional property law. This course studies those objectives and the laws response to them. The relationship between the parties, whether original or taken by assignment, are affected by statutory intervention as well as by the interpretation of the lease. The unit takes a critical look at the modern commercial lease, examining not only the current rules but also possible reform. The issues are viewed contextually, with an emphasis upon critical review of current law. This course is only concerned with English leases and requires a knowledge of the basic principles of English Property Law.
