Restitution is an essential component of the modern law of obligations and a matter of practical concern for commercial practitioners. Its central concerns are the reversal of unjust enrichment, including those remedies traditionally classified as quasi-contractual, and the unscrambling of defective transactions. The unit considers various restitutionary techniques as they have emerged at common law and in equity. It considers the substantive content of the remedies and the juridical basis, if any, underlying them, primarily from the perspective of English law. Topics include the issues arising from failed contracts, the laundering of money and the fallout of corporate collapse.
