This unit seeks to explore the relationship between political theories of democracy and the state and approaches to the nature and functions of public law. It will consider the impact of political theories upon the principle and practice of law both by a means of analysis of the theoretical material and by evaluation of particular institutions, processes and case law in the light of such theoretical perspectives. The focus will be primarily upon public law in the UK, but some comparative analysis will be included.
