The unit introduces the student to the concepts of ownership, use and infringement of the various intellectual property rights under UK law. Although it can be said that patents, copyright and trade marks are three very disparate areas requiring different skills, the unit links them together by means of a comparison of the concepts of ownership, use and infringement, stressing the value of the interpretation of UK statutory materials. The unit will also consider the wider perspectives implicit in the ownership of intellectual property, in particular the economic, marketing and monopolistic aspects of the subject. The three main areas will be examined in the context of the network of International Conventions which form the basis of much of the relevant legislation, and particular emphasis will be placed on the impact of the Treaty of Rome on the existence and exercise of intellectual property rights within the European Community.
